ALASKA DEPARTMENT OF NATURAL RESOURCES NOTICE OF PRIVATE, NON-EXCLUSIVE EASEMENT ADL 109421Highland Estates Inc. We are NOT soliciting public comment on this posting. It provides notice that a decision was signed and issued only. In accordance with AS 38.05.850, the Division of Mining, Land and Water (DMLW) has issued a decision to issue a private, non-exclusive easement to Roger Schnabel (doing business as Highland Estates Inc.) for a 25-year term. The easement authorizes the use of approximately 0.45 acres of State land for the construction of a road, placement of utility lines, and completion of a DMLW-approved survey in the state-owned uplands of the Haines State Forest near Mosquito Lake, approximately six miles northwest of Klukwan, AK within Section 10, Township 28 South, Range 55 East, Copper River Meridian. An eligible person affected by this decision, and who provided timely written comment or public hearing testimony to the department, may appeal the decision to the DNR Commissioner per AS 44.37.011 and 11 AAC 02. Any appeal must be received within twenty (20) calendar days after issuance of this decision under 11 AAC 02.040. An eligible person must first appeal a decision to the Commissioner before seeking relief in superior court. The Alaska Court System establishes its own rules for timely appealing final administrative orders and decisions of the department. Appeals must be accompanied by the fee established in 11 AAC 05.160(d)(1)(F), which has been set at $200 under the provisions of 11 AAC 05.160 (a)-(b).
