Description
Notice Inviting Bids 1. Bid Acceptance and Opening. The City of Tracy ("City") will accept sealed bids for its CIP 77XXX Tracy Municipal Airport Remark Runways 12-30 and 8-26 Project ("Project"), by or before Wednesday, April 1, 2026, at 2:00 p.m., at the City Clerk's Office, 2nd Floor, 333 Civic Center Plaza, Tracy, California, 95376. Bids will be publicly opened immediately thereafter. 2. Location and Description. The Project is located at Tracy Municipal Airport, 5749 S. Tracy Boulevard, Tracy, California. Work includes Repainting the markings on Runway 12-30 and Runway 8-26 and the associated cross taxiways. 3. Time for Completion. The planned timeframe for work will begin after receipt of the FAA grant funding this project. Contract time to be six (6) working days. 3A. Liquidated Damages. If the Contractor refuses or fails to complete the work within the time specified, including authorized extensions, there shall be deducted from monies due the Contractor, not as a penalty, but as liquidated damages the sum of Three Thousand Dollars ($3,000.00) for each calendar day subsequent to the time specified and the time the work is actually completed and accepted. 4. License. In accordance with the California Public Contract Code 20103.5 when federal funds are involved in local agency contracts, no bid shall be invalidated by the failure of the bidder to be licensed in California at the time of bid opening. However, at the time of award, the selected contractor shall be properly licensed in accordance with the laws of the State and the City of Tracy. Contractor shall possess a valid Class A, General Engineering Contractor's License or C32, Parking and Highway Improvement Contractor License prior to award of Contract as approved by the Council. The said license shall be maintained during the contract period. It is the Bidder's and Contractor's responsibility to obtain the correct Contract's licenses. Bidders shall be skilled and regularly engage in the general class or type of work called for under this contract. 5. DIR Registration. Contractor must submit proof of DIR Registration with Bid Proposal. 6. Contract Documents. Bids are required for the entire project work and shall be made upon the Bid Forms in accordance with the Instructions to Bidders. Pursuant to California Labor Code Section 1773, the City has ascertained the General Prevailing Rate of Wages in the County in which the work is to be done to be as determined by the Director of Industrial Relations of the State of California. The Contractor is hereby made aware that information regarding prevailing wage rates may be obtained from the State Department of Industrial Relations and/or the following website address: http://www.dir.ca.gov/DLSR. Further, all labor on the project shall be paid no less than the minimum wage rates as established by the U.S. Secretary of Labor. The higher of the two rates shall be paid. 8. Bonds. The successful bidder will be required to provide performance and payment bonds, each for 100% of the maximum Contract Price, and a warranty bond for 10% of the maximum Contract Price. 9. Substitution of Securities. Substitution of appropriate securities in lieu of retention amounts from progress payments is permitted under Public Contract Code section 22300. 10. Subcontractor List. A completed Subcontractor List form must be submitted with the Bid Proposal in accordance with the Instructions to Bidders. 11. Pre-Bid Conference. A non-mandatory pre-bid conference will be held at 9:00 A.M. on March 16th, 2026, at Tracy Municipal Airport, 5749 South Tracy Boulevard, Tracy, California 95377. All prospective bidders are encouraged to attend this meeting. 12. Award. The award of this project is contingent upon a grant offer from the Federal Aviation Administration and acceptance of the grant offer by the City of Tracy. 13. Federal Provisions: The work to be done is being financed in whole or in part by means of a grant made by the United States acting through the Federal Aviation Administration of the Department of Transportation. This project is subject to the Federal provisions, statutes and regulations as set forth in the project specifications: This project is under and subject to the Federal Fair Labor Standards Act and the Wage Rate Decision contained in the contract documents. The requirements of 49 CFR Part 26, including any amendments thereto, apply to this contract. It is the policy of the Sponsor to practice nondiscrimination based on race, color, sex, or national origin in the award or performance of this contract. The Sponsor encourages participation by all firms qualifying under this solicitation regardless of business size or ownership. 14. Title IV - Civil Rights Act. As a condition of a grant award, the Sponsor shall demonstrate that it complies with the provisions of Title VI of the Civil Rights Act of 1964 (42 U.S.C. §§ 2000d et seq) and implementing regulations (49 CFR part 21) including amendments thereto, the Airport and Airway Improvement Act of 1982 (49 U.S.C. § 47123), the Age Discrimination Act of 1975 (42 U.S.C. 6101 et seq.), Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. § 794 et seq.), the Americans with Disabilities Act of 1990 (42 U.S.C. § 12101, et seq.), U.S. Department of Transportation and Federal Aviation Administration (FAA) Assurances, and other relevant civil rights statutes, regulations, or authorities, including any amendments or updates thereto. This may include, as applicable, providing a current Title VI Program Plan to the FAA for approval, in the format and according to the timeline required by the FAA, and other information about the communities that will be benefited and impacted by the project. A completed FAA Title VI Pre-Grant Award Checklist is required for every grant application, unless excused by the FAA. The Sponsor shall affirmatively ensure that when carrying out any project supported by this grant that it complies with all federal nondiscrimination and civil rights laws based on race, color, national origin, sex, creed, age, disability, genetic information, in consideration for federal financial assistance. The Department's and FAA's Office of Civil Rights may provide resources and technical assistance to recipients to ensure full and sustainable compliance with Federal civil rights requirements. Failure to comply with civil rights requirements will be considered a violation of the agreement or contract and be subject to any enforcement action as authorized by law. 15. Small Business Participation. The Sponsor has established a Small Business Element in accordance with 49 CFR Part 26 to facilitate competition by small business concerns, taking all reasonable steps to eliminate obstacles to their participation and to create a level playing field on which small businesses can compete fairly. While there is no specific numerical goal assigned to small business participation the prime contractor should make every effort to solicit small business concerns (as defined in 13 CFR Part 121) to participate as subcontractors, service providers, suppliers, etc. The Bidder must submit the Small Business Participation information with its proposal on the forms provided herein (Fostering Small Business Participation & Non-Certified Small Business Verification Form). 16. Socially/Economically Disadvantaged Financial Institutions. The Sponsor encourages Contractors and Subcontractors to utilize the services of financial institutions owned and controlled by socially and economically disadvantaged individuals in the community.
